These are the terms and conditions for the provision of driving lessons by DRM Instructors
All DRM Instructors are Self Employed and are licensed to use the DRM Driver Training Formula. Your contract is with your driving instructor who is solely responsible for delivering your training and any other services. For the avoidance of doubt, DRM (UK) Ltd trading as DRM Driver Training is not responsible for the actions or omissions of your DRM Instructor and shall be under no liability whatsoever for any loss, damage, injury or expense, arising directly or indirectly from any such actions or omissions of your DRM Instructor.
Please ensure that you can read a new style number plate from 20 metre (20.5 m for the old style) and that you bring both the paper and photo-card parts of your provisional driving licence to the first lesson.
By accepting your first driving lesson, you thereby accept these Terms of Business and your contract being with your DRM Instructor.
General Conduct
Your DRM Instructor is bound by a professional code of conduct, which ensures that all DRM Instructors will be polite, tidy and will not smoke in the car while giving tuition. They behave in a correct, professional and ethical manner at all times.
Qualifications
The Driving Standards Agency (DSA), part of the Department for Transport, is the agency that examines, licences and controls the standards of all driving instructors in the UK. Your DRM Instructor is examined, licensed and regularly checked by the DSA to give Professional Driving Lessons. In addition they are specially trained in the correct way to deliver the DRM Training Formula to ensure that you learn more in each lesson. DRM Driver Training and DRM Instructors strive to deliver the highest quality of service and training. If you have any questions or doubts about your training, please contact your DRM Instructor or the Office without delay to discuss them.
Vehicle
Your DRM Instructor gives you your tuition in his/her car, which is properly insured for this purpose and for use in driving tests. The car is fitted with dual controls, is correctly maintained, and kept clean and tidy at all times.
The DRM Training Formula
Your DRM Instructor will supply you with the DRM Training Pack for the part refundable deposit, which will be refunded provided the required items are returned in good condition. A deduction will be made for the damage to returned items. If you have already passed your Theory Test, the theory test items in the pack will not be supplied. Your DRM Instructor will tell you how and when to use these training aids. He/she will also update your progress chart at the end of each lesson so you know exactly how well and how quickly you are progressing. Remember to bring your DRM Progress Chart with you on each lesson.
Speed of learning
The rate at which different people learn can vary considerably. The courses DRM Instructors deliver are designed for people who pick up the practical skills without difficulty, to achieve the required standard at the end of the course. However, should an individual take longer to master any part of the training, this may require extra training and practice. If you are falling behind with your progress, your DRM Instructor will discuss this with you in good time. It is, therefore, possible that taking a Course on its own, may not give enough practice to achieve the standard required to pass the test. The responsibility for learning lies not only with the instructor, but more so with the pupil. At a college, you book a course and have to attend all the classes on a regular basis. Students who do not attend regularly fail their exams. DRM have developed a structured course for your DRM Instructor to teach you to drive and this also needs consistent attendance by the student. This is particularly important before the test. Pupils who miss or cancel their regular driving lessons take far longer to achieve test standard. To avoid possible interruptions, pupils should switch off their mobile phones at the start of the lesson.
Provisional driving licence
You must ensure that hold a valid current provisional driving licence and that you have signed it in ink. Your DRM Instructor will ask to see it on your first lesson.
Bookings
Lesson bookings made with your driving Instructor are provisional until your instructor has confirmed them to the Office. It is in your best interest to book lessons 3 or 4 weeks ahead to avoid the disappointment of the times most convenient to you.
Lesson start times
Your DRM Instructor will make every effort to meet you at the start of the time booked for your lesson. However, this is dependent upon traffic conditions so you are asked to be prepared to start 10 minutes earlier or later that the time booked. Irrespective of the time of arrival of your DRM Driving Instructor, the full lesson time booked will be given.
Cancellations
Please give your DRM Instructor, directly or via the Office, as much notice as possible should you have to cancel or change a lesson. As your DRM Instructor is self-employed, should he/she be unable to re-book a lesson with another pupil, he/she personally loses the income. You may, therefore be charged for a cancelled lesson by your DRM Instructor if less than 48 hours notice is given to him/her. Pupils have the reciprocal right.
Theory and Driving Tests
The law says you must pass your Theory Test before you or the office can BOOK your Driving Test. You must have the paper and photo-card parts of your signed Provisional Driving Licence with you for each test. For the Theory Test, you must also have your Theory Test appointment letter (or failing this your booking reference number) with you. For the Driving Test you must have your appointment letter and your theory test certificate with you.
Driving Tests
Your DRM Instructor will advise you when you are ready for your test. In the interest of public safety your DRM Instructor reserves the right not to present you for test in his/her car if in his/her opinion you are not up to the standard required. Driving Test bookings take preference over lesson bookings – if your lesson has to be changed because of somebody else’s test, your DRM Instructor will let you know as soon as possible. Please tell your DRM Instructor, directly or via the Office, your test date as soon as you receive it so that the car can be reserved for you. If you leave this to near the test time, your DRM Instructor may decline to present you for the test, if in his/her opinion you need further tuition.Your DRM Instructor will reserve a two hour lesson for your test period, the first hour will be a warm up lesson, followed by the test in the second hour. Tests and test bookings are carried out by the DSA, thus your DRM Instructor is not responsible for any cancellations or postponements. He/she will help you to reclaim any out of pocket expenses you have lost as a result of cancellations.
Payments
All payments should be made prior to, or at the start of, each lesson. Individual lesson payments are made directly to the instructor. Course, block bookings or test payments must be paid into the DRM Client Account*, either through your DRM Instructor or through the office.
*DRM (UK) Ltd operates a DRM Instructor’s Client Account at the request of and on behalf of its Franchised Driving Instructors, who will issue you with a DRM Client Account receipt for each payment you make. The Client Account ensures that your money is held safely until you receive the lessons. Payments can be made by cash, cheque, bank transfer, credit or debit card. Payments by cheque for individual lessons are made payable to your instructor and for courses, block bookings or tests made payable to DRM (UK) Ltd Client Account. Cheques not honoured by the bank will incur an administration charge of £10. Card payments should be made by phoning the DRM Office prior to your lesson and incur a small administration charge. Course booking deposits and payments for special offers are non refundable. One week course fees will not be refunded if the course is cancelled less that 8 days before the start date of the course. The DRM money back guarantee of unused lesson on passing your test is offered by the DRM Instructor not by DRM Driver Training. To obtain a refund, once you have passed your driving test with your DRM Instructor, you should send a letter of request with a copy of your DRM Client Account receipt, to your DRM Instructor. Refunds incur a 10% administration fee.
Complaints
If you are not happy in any way with the training your instructor has provided, or with your instructor or any other part of the service, please let your DRM Instructor know so that the matter may be improved or corrected. If you are still not satisfied, please contact your nearest DRM Office, who will do everything possible to put the matter right.
Data Protection Act
The Data Protection Act prevents all driving instructors and DRM Staff from discussing a pupils training with parents or other third parties without written permission from the pupil. Should pupils wish such information to be divulged, their DRM Instructor will provide a letter that they should sign.
The above Terms of Business form part of the DRM Instructor Franchise Agreement between the instructor & DRM (UK) Ltd, trading as DRM Driver Training.
